TERMS AND CONDITIONS OF HIRE

 

The following are the Terms and Conditions of Hire between the Hirer and Adventure Kit. Note that the Terms and Conditions of Hire listed on our website at www.adventurekit.ie  will have the revision and date. Adventure Kit reserve the right to make changes to Terms and Conditions of Hire at any time, therefore the latest version will be issued to customers during Booking Confirmation process and as the part of the Rental Agreement.

The latest version of Terms and Conditions of Hire together with all documents requested at the time of booking and documents signed upon collection of the equipment combine to form the Rental Agreement. All hired equipment and all additional parts/elements being part of the Kits remain the property of Adventure Kit at all times.

All payments for rentals to Adventure Kit are inclusive of VAT.

Reservations and Payments

A reservation with Adventure Kit is confirmed when a Booking Deposit or (in the case of bookings within 6 weeks of hire) the Full Rental Payment has been received. A booking is only complete when all balance payments, the security deposits and all required documents have been received. The Hirer shall receive a Booking Email containing their rental details, payment schedule and checklist of required documents. Confirmation emails will be issued upon receipt of any payments or documentation received.

Booking and Security Deposits

Booking Deposit will represent 30% of the equipment hire cost presented on the Booking Order. Booking Deposit must be paid not later than 5 days from Payment Request being issued. If payment is not received within specified time, the Reservation will be cancelled.

Security Deposit must be paid not later than 5 days before hire Start Date. If payment is not received within specified period, the Reservation will be seen as cancelled by Hirer and refunds will be issued with Refund Policy specified below in section Cancellation by Hirer.

Card Payment Fees

Adventure Kit uses Stripe platform for website payments. Stripe card payment fees will be added as the additional item for each payment. Fees can be found on  https://stripe.com/ie/pricing

Security Deposits

Security Deposit is required on all hire equipment as specified in prices for each product. The Security Deposits must be paid at least 5 days before the collection day.

The Security Deposit or Deposits will be refunded in full within seven days of return of the hired equipment on the following conditions:

  • No damage to hired equipment or any third party.
  • No malfunction, breakdown or repairs caused by the negligence of the Hirer. The Hirer is required to check condition of hired equipment before leaving premises and during the hire to secure the safety of users.
  • Equipment is returned to the agreed location, on the agreed date and time.
  • Returned Equipment is in the same condition as collected, the interior cleaned including all cooking utensils and camping equipment where applicable.
  • No additional cleaning required due to the carriage of pets.
  • No additional costs have been incurred during the period of rental, e.g.: violation of traffic laws or regulations.
  • Equipment was not used by anyone other than those named in the Rental Agreement.
  • Additional cleaning fees may be charged against the deposits if the equipment is not returned with the interior and exterior in a clean condition. The cleaning fee will depend on the extend of the required cleaning. See Cleaning & Associated Fees in Terms and Conditions Section.

Adventure Kit reserves the right to decline a hire or increase the security deposits for specific events e.g.: festivals, rallies, or promotional events.

Pricing

Prices for hire of equipment can be found on product pages on www.AdventureKit.ie.

Adventure Kit reserves the rights to cancel reservation if the ordered equipment has been incorrectly priced due to manual errors.

The Hirer and/or Drivers

The Hirer must comply, and is liable for ensuring that the Driver(s) comply with the following obligations:

  • Shall not lend or hire any of the Adventure Kit equipment to a third party.
  • Shall not carry more weight in hired equipment than the permitted capacity of the equipment.
  • Shall not use any of the Adventure Kit equipment for carriage of goods for hire or reward.
  • Shall not move the Adventure Kit equipment outside of Ireland (North & South). Any expenses incurred recovering the Adventure Kit equipment from overseas shall be the responsibility of the Hirer.
  • Shall use the Adventure Kit equipment only as specified by manufacturer and only use for the recreational purpose.
  • Shall restrict use of the Adventure Kit equipment in certain areas due to adverse road or weather conditions, or any other reasonable cause.
  • Shall be responsible for the costs of recovery of the Adventure Kit equipment that has become bogged or immovable due to movement over unsteady or uneven surfaces.
  • Shall not carry volatile liquids or gases (other than the LPG canisters provided), explosives or other corrosive or flammable materials.
  • Shall not permit smoking in the hire equipment.
  • Undertakes to keep the Adventure Kit equipment safe and securely locked at all times when unattended.
  • Shall ensure that the Driver(s) is/are fit and capable at all times.
  • Shall not allow the Adventure Kit equipment to be towed by anyone other than those declared and named and in the Adventure Kit documentation.
  • All equipment hired by Hirer from Adventure Kit remains at all times the property of the Adventure Kit.

NOTE: Allowing any of the Adventure Kit equipment to be towed or used by anyone other than those declared and named and in the Adventure Kit Rental Agreement documentation will result in full loss of the Hirer’s security deposits.

Insurance

Hirers must present motor insurance for the vehicle that Adventure Kit equipment will be towed with clearly indicating and confirming fully comprehensive towing insurance in place. All Hirers of towing equipment must submit copies of their full drivers licence (front & back) IN ADVANCE of the rental. UK drivers must submit copies of both their plastic card licences and a Driver Check Code for online verification. Hirers from outside Ireland and the UK must also submit copies of a valid passport or identity card as proof of ID. Drivers are required to present their drivers licence on the day of hire. Please note that if these documents are not available in advance on the day of the hire, Adventure Kit will be unable to proceed with the Hire.

It is illegal to drive without valid insurance in Ireland and EU.

We strongly recommend taking holiday, camping and travel insurance.

Damage to or loss of Equipment

The Hirer shall be fully responsible for the cost of a replacement of Adventure Kit Equipment in case of damage or loss (including theft) of the hired equipment and any part thereof.

The Hirer shall take any action to secure and supervise hired equipment during the rental time. The Hirer is fully liable for hired equipment until it has been returned to the Adventure Kit representative and End of Hire document has been issued.

The Hirer will be fully responsible for all costs and expenses in respect of:

  • rectifying any damage to the Equipment (fair wear and tear excepted) which occurred during the period in which the Equipment was at the Hirer’s risk; and
  • cleaning the Equipment following collection of the Equipment, in each case to return the Equipment to a condition fit for rehire. Such costs and expenses shall be confirmed to the Hirer by Adventure Kit subject to supporting documentation. In addition, the Hirer will continue to pay the Charges until any repairs and or cleaning have been completed; and
  • the Replacement Cost in respect of lost or stolen Equipment and/or Equipment which is beyond economic repair and the Hirer will continue to pay the Charges, until the Replacement Cost has been received by Adventure Kit.

Violation of Traffic Laws and Regulations

Driver(s) are personally liable for all legal penalties and fees pertaining to any traffic violation infringements under the current Road Traffic Legislation applicable in the Republic of Ireland or Northern Ireland. The driver(s) will be liable for any penalties and fees received during their rental.

Breakdown

All issues should be reported immediately to Adventure Kit by telephone on +353(0)85116 8648. Failure to contact Adventure Kit may impact your security deposits and may result in the loss of any refunds due as a result of breakdown. The Hirer should never engage the help of a third-party mechanic or any other repairs person without first contacting Adventure Kit.

A replacement equipment may be offered subject to availability.

Adventure Kit cannot accept liability for any costs arising from accident, breakdown or any other cause, e.g., replacement vehicle costs, travel, accommodation. Adventure Kit liability extends only to either replacing the equipment or refunding your hire charge for any days you lose the total use of the hired equipment.

Depending on the circumstances, we reserve the right not to replace the hire equipment.

Accidents

Any accident or incident causing damages must be reported immediately to Adventure Kit by telephone on +353 (0)85 116 8648. Failure to contact Adventure Kit may impact your security deposits and may result in the loss of any refunds due as a result of the accident or damages Please see Damage to or loss of equipment section.

The Hirer is solely responsible for any accidents and damages caused to themselves, third party and any property while using Adventure Kit hired equipment.

In case of an Accident or Damages cause by a Third Party please take the following steps:

  • Report the Incident to Adventure Kit by telephone as soon as possible.
  • Inform the Garda (Police in Republic) / Police Service Northern Ireland (PSNI) and obtain an Incident or Crime Number.
  • Note the name, phone number and address of the third party, other driver and the vehicle owner, if different.
  • Note the name, phone number and address of each witness.
  • Describe any injury to yourself or others.
  • Describe damage to vehicle(s), other property and hired equipment.
  • Note the name and address of the other driver’s insurance company (See insurance disc on windscreen).
  • Note the number of certificate of insurance (See insurance disc on windscreen).
  • Note the registration number of other vehicle(s).
  • Note the name or Number of any Garda at the scene or any AA patrol attending.
  • Provide Adventure Kit with the copy of the Garda report.
  • Note the location of accident.
  • Take photographs of the scene if you have a camera.
  • If possible please also take the following steps:
    • Note the speed of vehicles involved.
    • Note the width of road, road markings, state of road surface, weather conditions, visibility, time of day.
    • Describe the debris or marks on the road relevant to the accident.
    • Describe the manner of other driver’s driving.
    • Draw a rough sketch of vehicle positions before and after the accident.
    • Note whether other driver and passengers were wearing seatbelts.

Any accidental damage caused to any vehicle and hired equipment during the Rental Agreement but still on Adventure Kit premises shall be deemed as the Hirer’s responsibility.

Cancellations by Adventure Kit

Adventure Kit reserve the right to cancel a reservation at the proposed commencement of hire if:

  • Required documents are not produced or valid in accordance with stated conditions.
  • Failure to provide funds for payment of hire and/or security deposits.
  • Address on driving licence does not match booking/billing address. Additional proof of ID is required in the form of a recent utility bill or a bank/building society statement.
  • Hirers from outside Ireland and the UK fail to provide a valid passport or national identity card alongside driving licence as proof of id.

Adventure Kit reserve the right to refuse to hire to any person, without stating cause.

Transaction fees such as credit card, Paypal, Stripe or any other type of third party fees are non-refundable.

Cancellation by Hirer

It is advisable to purchase holiday cancellation insurance.

COVID-19 Policy:

If your booking or hire dates are directly affected by travel restrictions due to Covid-19 we can offer Reschedule of the hire dates to a future date up to 30 days in advance of your hire start date. If there is a price difference, it will apply.

Otherwise our normal cancellation policy detailed here below will apply.

In the event of a cancellation by the Hirer the following charges shall be incurred per equipment booked:

  • Within 1 week of rental AND no show: 100% of rental payments.
  • Within 6 weeks of rental: 100% of booking deposit.
  • From 12 to 6 weeks before rental: 50% of booking deposit.
  • More than 12 weeks before rental: €50 administration fee.
  • €20 cancellation fee may be taken at our discretion if a booking is cancelled more than 6 months in advance of hire to cover credit card and other transnational fees.
  • Transaction fees such as credit card, Paypal, Stripe or any other type of third party fees are non-refundable.

Availability/Choice of Equipment

Adventure Kit shall make every effort to ensure that the equipment reserved by the Hirer is available for the agreed rental. If for any reason it is not available, we reserve the right to make another type of the equipment available without extra cost. BUT if this is not acceptable or another equipment proves unobtainable, our liability is limited to the refund on any money paid to Adventure Kit by the Hirer.

Collection & Return

Equipment may be collected 5 days a week Monday – Friday only at agreed day and time as specified in rental Agreement Start Date.

Equipment must be returned on agreed day and time as specified in Return Date of Rental Agreement. Any variation from that Date will incur additional hire charges if return is after the Return Date and/or additional surcharges if out of hours days and times are chosen for the Start or Return Date. 

At least 24 hours’ notice is required to change your allocated Start Date or Return Date. Please understand that all Adventure Kit equipment is carefully coordinated and scheduled so last-minute changes can have a domino effect. Please consider that the next customer may be collecting the equipment within hours of your Return Date.

If the hired equipment is returned late without the Adventure Kit consent or knowledge (i.e. outside the agreed Return Date and min 24 hours’ notice), Adventure Kit reserves the right to charge additional hire fees.

The additional hire fee will be charged accordingly as the prices specified as “Min 4 Days and Weekends” for each equipment hired. If the return date is delayed beyond 2 days this fee will be multiplied for each additional day of late return.

Adventure Kit reserve the right to deduct these additional hire charges from the Security Deposit or directly charge the bank card provided for the hire when the Security Deposit value do not cover the additional hire charges or Security Deposit had to be utilized to cover damages to the hired equipment.

Adventure Kit reserves the right to wave the additional hire fee in full or part of. This will depend on the circumstances of the late return.

No refund is given for a late collection or early return of the hired equipment for any reason, (e.g. connecting transport delays, flight disruption, change of mind/heart, accident, weather, or theft). It is advisable to purchase holiday cancellation insurance. The breakdown or malfunction of equipment after the hired equipment has left the premises will not be accepted as reason to abort or cancel the Rental Agreement, and any such fault will be rectified as soon as possible. Any accidental damage caused to a hired equipment under Rental Agreement but still on Adventure Kit premises shall be deemed as the Hirer’s responsibility.

The Hirer is responsible for returning equipment clean and functional as at the point of Hire. Upon return Adventure Kit’s representative will check the hired equipment for damage, cleanliness and inventory.

Smoking

Smoking is not permitted in hired equipment or while using hired equipment.

Cleaning & Associated Fees

Standard cleaning is included in the cost of hire.

Any spillage, marking, painting and etc on any part of the hired equipment will incur additional cost that will be deducted from Security Deposits

Adventure Kit reserves the right to make the following additional charges for cleaning if necessary:

  • €50 for the cleaning of stained upholstery. This maybe increased to €100 in extreme cases.
  • €50 for a very dirty interior.
  • €200 if the no smoking clause has been ignored.
  • €20 for the disposal of rubbish or unwanted goods left in campers or at Adventure Kit’ premises.
  • €100 for additional cleaning after pets.

Pets

Adventure Kit allows well-behaved pets in hired equipment however a charge of €100 to cover additional cleaning fees will apply.

Anny damages made by pets are Hirer full responsibility. Please see Damage to or loss of Equipment section

Personal Car Parking & Storage

We do not provide any personal car parking or storage facilities.

Complaints

Adventure Kit are contactable throughout the rental period. All faults, damage or complaints must be reported immediately to Adventure Kit or at the latest on return of the hired equipment. In the event that a complaint is not satisfactorily resolved upon return, the Hirer must inform Adventure Kit in writing within 14 working days.

Liability

Notwithstanding anything written herein to the contrary, the Hirer and the Adventure Kit acknowledge and agree that the Company trading under name: Adventure Kit will not be liable for any losses or damages, whether indirect, incidental, special or consequential, in profits, goods or services, irrespective of whether or not the Buyer has been advised or otherwise might have anticipated the possibility of such loss or damage.

In any event of the liability, Hirer agrees to limit the liability arising from the Adventure Kit professional obligations that the total liability of the Adventure Kit in any event shall not exceed the total fees paid by the Hirer to Adventure Kit for products and services under the

Governing Law and Jurisdiction

These Terms and any all Contracts and any non- contractual obligations arising out of or in connection with them will be governed by Irish law.

Adventure Kit and the Hirer agree that the Irish courts have exclusive jurisdiction to determine any dispute arising out of or in connection with these Terms and any and all Contracts (including in relation to any non-contractual obligations).

Transaction fees such as credit card, Paypal, Stripe or any other type of third party fees are non-refundable.

Cancellation by Hirer

It is advisable to purchase holiday cancellation insurance.

COVID-19 Policy:

If your booking or hire dates are directly affected by travel restrictions due to Covid-19 we can offer Reschedule of the hire dates to a future date up to 30 days in advance of your hire start date. If there is a price difference, it will apply.

Otherwise our normal cancellation policy detailed here below will apply.

In the event of a cancellation by the Hirer the following charges shall be incurred per equipment booked:

  • Within 1 week of rental AND no show: 100% of rental payments.
  • Within 6 weeks of rental: 100% of booking deposit.
  • From 12 to 6 weeks before rental: 50% of booking deposit.
  • More than 12 weeks before rental: €50 administration fee.
  • €20 cancellation fee may be taken at our discretion if a booking is cancelled more than 6 months in advance of hire to cover credit card and other transnational fees.
  • Transaction fees such as credit card, Paypal, Stripe or any other type of third party fees are non-refundable.

Availability/Choice of Equipment

Adventure Kit shall make every effort to ensure that the equipment reserved by the Hirer is available for the agreed rental. If for any reason it is not available, we reserve the right to make another type of the equipment available without extra cost. BUT if this is not acceptable or another equipment proves unobtainable, our liability is limited to the refund on any money paid to Adventure Kit by the Hirer.

Collection & Return

Equipment may be collected 5 days a week Monday – Friday only at agreed day and time as specified in rental Agreement Start Date.

Equipment must be returned on agreed day and time as specified in Return Date of Rental Agreement. Any variation from that Date will incur additional hire charges if return is after the Return Date and/or additional surcharges if out of hours days and times are chosen for the Start or Return Date. 

At least 24 hours’ notice is required to change your allocated Start Date or Return Date. Please understand that all Adventure Kit equipment is carefully coordinated and scheduled so last-minute changes can have a domino effect. Please consider that the next customer may be collecting the equipment within hours of your Return Date.

If the hired equipment is returned late without the Adventure Kit consent or knowledge (i.e. outside the agreed Return Date and min 24 hours’ notice), Adventure Kit reserves the right to charge additional hire fees.

The additional hire fee will be charged accordingly as the prices specified as “Min 4 Days and Weekends” for each equipment hired. If the return date is delayed beyond 2 days this fee will be multiplied for each additional day of late return.

Adventure Kit reserve the right to deduct these additional hire charges from the Security Deposit or directly charge the bank card provided for the hire when the Security Deposit value do not cover the additional hire charges or Security Deposit had to be utilized to cover damages to the hired equipment.

Adventure Kit reserves the right to wave the additional hire fee in full or part of. This will depend on the circumstances of the late return.

No refund is given for a late collection or early return of the hired equipment for any reason, (e.g. connecting transport delays, flight disruption, change of mind/heart, accident, weather, or theft). It is advisable to purchase holiday cancellation insurance. The breakdown or malfunction of equipment after the hired equipment has left the premises will not be accepted as reason to abort or cancel the Rental Agreement, and any such fault will be rectified as soon as possible. Any accidental damage caused to a hired equipment under Rental Agreement but still on Adventure Kit premises shall be deemed as the Hirer’s responsibility.

The Hirer is responsible for returning equipment clean and functional as at the point of Hire. Upon return Adventure Kit’s representative will check the hired equipment for damage, cleanliness and inventory.

Smoking

Smoking is not permitted in hired equipment or while using hired equipment.

Cleaning & Associated Fees

Standard cleaning is included in the cost of hire.

Any spillage, marking, painting and etc on any part of the hired equipment will incur additional cost that will be deducted from Security Deposits

Adventure Kit reserves the right to make the following additional charges for cleaning if necessary:

  • €50 for the cleaning of stained upholstery. This maybe increased to €100 in extreme cases.
  • €50 for a very dirty interior.
  • €200 if the no smoking clause has been ignored.
  • €20 for the disposal of rubbish or unwanted goods left in campers or at Adventure Kit’ premises.
  • €100 for additional cleaning after pets.

Pets

Adventure Kit allows well-behaved pets in hired equipment however a charge of €100 to cover additional cleaning fees will apply.

Anny damages made by pets are Hirer full responsibility. Please see Damage to or loss of Equipment section

Personal Car Parking & Storage

We do not provide any personal car parking or storage facilities.

Complaints

Adventure Kit are contactable throughout the rental period. All faults, damage or complaints must be reported immediately to Adventure Kit or at the latest on return of the hired equipment. In the event that a complaint is not satisfactorily resolved upon return, the Hirer must inform Adventure Kit in writing within 14 working days.

Liability

Notwithstanding anything written herein to the contrary, the Hirer and the Adventure Kit acknowledge and agree that the Company trading under name: Adventure Kit will not be liable for any losses or damages, whether indirect, incidental, special or consequential, in profits, goods or services, irrespective of whether or not the Buyer has been advised or otherwise might have anticipated the possibility of such loss or damage.

In any event of the liability, Hirer agrees to limit the liability arising from the Adventure Kit professional obligations that the total liability of the Adventure Kit in any event shall not exceed the total fees paid by the Hirer to Adventure Kit for products and services under the

Governing Law and Jurisdiction

These Terms and any all Contracts and any non- contractual obligations arising out of or in connection with them will be governed by Irish law.

Adventure Kit and the Hirer agree that the Irish courts have exclusive jurisdiction to determine any dispute arising out of or in connection with these Terms and any and all Contracts (including in relation to any non-contractual obligations).
